Our scope of services in Real Property Law include: identifications, measurements, negotiations, acquisitions, and obtaining the necessary easements and rights of way for the construction and operation of  Real projects involving: housing, hydraulic, penitentiary, energy generation and waste disposal; as well as highways and pipe lines across the Mexican Territory.

Anent Litigation, we have successfully handled the disincorporation of “ejido” Lands and obtained definitive resolutions to obtain the restitution of property of Farm Lands. All these actions give value and social content to the actions we sponsor.  Our rosters of clients vary from private corporations and governments to communities and individuals.

These are some matters in which O’Gorman&Hagerman, his partners or collaborators have participated as responsible for legal work and/or social management:

  • Release of the right-of-way of additional areas of theOaxaca-Puerto Escondido highway, Barranca Larga-Ventanilla stretch,102 km (2015 to date).
  • Expropriation of land in Oaxaca affected by the Paso Ancho Dam and obtaining the easements necessary for its construction and operation (2014 to date).
  • Disincorporation and acquisition of ejido lands in Nayarit , for the construction of a geothermal energy generation plant (2014 to date)
  • Release of the right of way in Veracruz and Tamaulipas for the construction of the Tuxpan-Tampico Expressway , including land use change for forest land (2014).
  • Legal audit of land in San Luis Potosí, Aguascalientes and Guanajuato for the acquisition of polygons of 800 hectares for the construction and operation of 3 200 MW solar power plants (2015) .
  • Disincorporation and acquisition of ejido lands in Oaxaca , and community management for the installation and operation of the Integral Solid Waste Management Center of the City of Oaxaca (2013 to The date).
  • Acquisition of land in Oaxaca for the construction of a Federal Social Readaptation Center (2011-2012).
  • Disincorporation and acquisition of ejidal lands in Hidalgo , for the construction of housing development (2010-2012).
  • Disincorporation and acquisition of land in an ejido in the municipality of Acolman, Estado de México , as well as the change of land use of more than 500 hectares for integral urban development (2008-2012).

Finally, we listed some of the O’Gorman & Hagerman litigation in agrarian matters:

  • Representation of a mining company in an indirect amparo promoted by a community in the Sierra de Juárez , Oaxaca seeking a definitive closure of a gold mine and silver claiming that it is within the property recognized to the community, contaminates its lands and waters, and granted concessions without prior consultation. In this case we succeeded in getting a suspension of the plan granted to the community and then denied the definitive suspension.
  • Representation of the owners of a certain property located on the Miguel Aleman Coast , Acapulco municipality, Guerrero, filed against it by the Icacos ejido . We won this case in all instances and it was declared that the Icacos ejido no longer has land in Acapulco.
  • Representation of a company housing developer in two agrarian lawsuits filed against them by ejidatarios of an ejido in the municipality of Tlajomulco de Zúñiga, Jalisco, por the divestment of lands for a development of 4,000 houses . In this trial we succeeded in maintaining the precautionary measures granted to ejidatarios for more than 2 years.
  • Representation of a ejido in the municipality of Lázaro Cárdenas, Quintana Roo, in an agrarian trial to obtain restitution of 17,340 hectares granted in usufruct to a company. In this trial we obtained that the Higher Agrarian Court issued a judgment recognizing that the usufruct was left without effects.
  • Representation of a real estate in a agrarian trial promoted by an ejido in the State of Mexico, which seeks to restore a property acquired by the real estate company, in which A commercial square is built.
  • Representation of a ejido in the State of Mexico in agrarian lawsuits brought against them by the parents’ associations of two schools, claiming nullity Of exchanges of certain school parcels necessary for the construction of a campus of the Autonomous University of the State of Mexico. In these judgments we managed to absolve the ejido in all instances.
  • Representation of a hotel group in the defense of certain areas located in the municipality of Solidaridad , Quintana Roo, which border on 2 kilometers with the beach, in relation to measurement procedures and Demarcation of national land , and titling outside auction processed before the SEDATU, with the aim of guaranteeing respect for the property and the vicinity of the land.
